(1) Any person holding a license for an aquaculture facility may transport the live aquatic animals specified on the license to the facility or to any person who has been issued a license or who is otherwise authorized by law to possess those aquatic animals.
Terms Used In Utah Code 4-37-203
- Aquaculture: means the controlled cultivation of aquatic animals. See Utah Code 4-37-103
- Aquaculture facility: means any tank, canal, raceway, pond, off-stream reservoir, or other structure used for aquaculture. See Utah Code 4-37-103
- Aquatic animal: includes a gamete of any species listed in Subsection (3)(a). See Utah Code 4-37-103
- Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-1-109
- Private fish pond: means the same as that term is defined in Section 23A-1-101. See Utah Code 4-37-103
- Short-term fishing event: means the same as that term is defined in Section 23A-1-101. See Utah Code 4-37-103
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) Each transfer or shipment of live aquatic animals from or to an aquaculture facility within the state shall be accompanied by documentation of the source and destination of the fish, including:
(2)(a) name, address, license number, and health approval number of the source;
(2)(b) number and weight being shipped, by species;
(2)(c) name of the recipient;
(2)(d) address of the destination; and
(2)(e)
(2)(e)(i) license number of the receiving facility; or
(2)(e)(ii) location of the private fish pond or short-term fishing event when authorized to receive the aquatic animal without a certificate of registration under Division of Wildlife Resources rules.
