Terms Used In Utah Code 4-37-302

  • Aquaculture: means the controlled cultivation of aquatic animals. See Utah Code 4-37-103
  • Department: means the Department of Agriculture and Food created in Chapter 2, Administration. See Utah Code 4-1-109
  • Fee fishing facility: means a body of water used for holding or rearing fish for the purpose of providing fishing for a fee or for pecuniary consideration or advantage. See Utah Code 4-37-103
  • Person: means a natural person or individual, corporation, organization, or other legal entity. See Utah Code 4-1-109
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) aquaculture facilities within the state that have a license and health approval number;
     (1)(b) public aquaculture facilities within the state that have a health approval number; or
     (1)(c) sources outside the state that are health approved pursuant to Part 5, Health Approval.

     (2)(a) A person holding a license for a fee fishing facility shall submit to the department an annual report of all live fish purchased or acquired.
     (2)(b) The report shall contain the following information:

          (2)(b)(i) name, address, and license number of the seller or supplier;
          (2)(b)(ii) number and weight by species;
          (2)(b)(iii) date of purchase or transfer; and
          (2)(b)(iv) name, address, and license number of the receiver.
     (2)(c) The report shall be submitted to the department before a license is renewed or a subsequent license is issued.
