- Livestock: means cattle, sheep, goats, swine, horses, mules, poultry, domesticated elk as defined in Section
4-39-102 , or any other domestic animal or domestic furbearer raised or kept for profit. See Utah Code 4-1-109 - Property: includes both real and personal property. See Utah Code 68-3-12.5
(1)(a) “Agricultural operation” means the commercial production of crops, orchards, livestock, poultry, aquaculture, livestock products, or poultry products.
(1)(b) “Agricultural operation” includes:
(1)(b)(i) the real property where the commercial production described in Subsection (1)(a) occurs;
(1)(b)(ii) a facility, a property, or equipment used to facilitate the commercial production described in Subsection (1)(a);
(1)(b)(iii) an agritourism activity, as defined in Section 78B-4-512 ; or
(1)(b)(iv) an agricultural protection area established under Title 17, Chapter 41, Agriculture, Industrial, or Critical Infrastructure Materials Protection Areas.
(2) “Fundamental change to the operation” does not include:
(2)(a) a change in ownership or size;
(2)(b) an interruption of farming for a period of no more than three years;
(2)(c) participation in a government-sponsored agricultural program;
(2)(d) employment of new technology; or
(2)(e) a change in the type of agricultural product produced.
(3) “Nuisance” means anything that is injurious to health, indecent, offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property.
