Terms Used In Utah Code 41-3-201.5

  • Commission: means the State Tax Commission. See Utah Code 41-3-102
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
  • Motor vehicle: means a vehicle that is:
              (26)(a)(i) self-propelled;
              (26)(a)(ii) a trailer;
              (26)(a)(iii) a travel trailer;
              (26)(a)(iv) a semitrailer;
              (26)(a)(v) an off-highway vehicle; or
              (26)(a)(vi) a small trailer. See Utah Code 41-3-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
     (1)(a) A person may not, for a fee, commission, or other form of compensation, arrange, offer to arrange, or broker a transaction involving the sale or lease of more than two:

          (1)(a)(i) new or used motor vehicles in any 12 consecutive month period, unless the person is licensed under Subsection 41-3-202(1); or
          (1)(a)(ii) used motor vehicles in any 12 consecutive month period, unless the person is licensed under Subsection 41-3-202(2).
     (1)(b) Each transaction a person arranges, offers to arrange, or brokers involving the sale or lease of a motor vehicle for a fee, commission, or other form of compensation is a separate violation under this section if:

          (1)(b)(i) the person has for a fee, commission, or other form of compensation, arranged, offered to arrange, or brokered the sale or lease of more than two new or used motor vehicles within the previous 12 consecutive month period; and
          (1)(b)(ii) the person is not licensed under Subsection 41-3-202(1).
(2) A person who violates this section is guilty of a class B misdemeanor.
