(1) As used in this section:
Terms Used In Utah Code 41-6a-1011
- Operate: means the same as that term is defined in Section
41-1a-102 . See Utah Code 41-6a-102 - Operator: means :(49)(a) a human driver, as defined in Section
Utah Code 41-6a-102 - Pedestrian: means a person traveling:
(53)(a) on foot; or(53)(b) in a wheelchair. See Utah Code 41-6a-102- Person: means a natural person, firm, copartnership, association, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, governmental agency, public corporation, or any other legal or commercial entity. See Utah Code 41-6a-102
- Sidewalk: means that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. See Utah Code 41-6a-102
- Vehicle: means a device in, on, or by which a person or property is or may be transported or drawn on a highway, except a mobile carrier, as defined in Section
41-6a-1120 , or a device used exclusively on stationary rails or tracks. See Utah Code 41-6a-102(1)(a)(1)(a)(i) “Pedestrian vehicle” means a self-propelled conveyance designed, manufactured, and intended for the exclusive use of a person with a physical disability.(1)(a)(ii) A “pedestrian vehicle” may not:(1)(a)(ii)(A) exceed 48 inches in width;(1)(a)(ii)(B) have an engine or motor with more than 300 cubic centimeters displacement or with more than 12 brake horsepower; and(1)(a)(ii)(C) be capable of developing a speed in excess of 30 miles per hour.(1)(b) “Physical disability” means any bodily impairment which precludes a person from walking or otherwise moving about as a pedestrian.(2) A pedestrian vehicle operated by a person with a physical disability is exempt from vehicle registration, inspection, and operator license requirements.(3)(3)(a) A person with a physical disability may operate a pedestrian vehicle with a motor of not more than .5 brake horsepower capable of developing a speed of not more than eight miles per hour:(3)(a)(i) on the sidewalk; and(3)(a)(ii) in all places where pedestrians are allowed.(3)(b) A permit, license, registration, authority, application, or restriction may not be required or imposed on a person with a physical disability who operates a pedestrian vehicle under this Subsection (3).(3)(c) The provisions of this Subsection (3) supercede the provision of Subsection (2). - Pedestrian: means a person traveling:
