(1) Except as provided in Subsection (2), a bicycle or moped may not be used to carry more persons at one time than the number for which it is designed or equipped.

Terms Used In Utah Code 41-6a-1103

  • Bicycle: includes an electric assisted bicycle. See Utah Code 41-6a-102
  • Moped: means a motor-driven cycle having:
              (41)(a)(i) pedals to permit propulsion by human power; and
              (41)(a)(ii) a motor that:
                   (41)(a)(ii)(A) produces not more than two brake horsepower; and
                   (41)(a)(ii)(B) is not capable of propelling the cycle at a speed in excess of 30 miles per hour on level ground. See Utah Code 41-6a-102
  • Person: means a natural person, firm, copartnership, association, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, governmental agency, public corporation, or any other legal or commercial entity. See Utah Code 41-6a-102
(2) An adult rider may carry a child securely attached to the adult rider’s person in a back pack or sling.
