(1) A person or government agency may not operate a train in a manner to prevent vehicular use of a roadway for a period of time in excess of five consecutive minutes except:

- Highway: means the entire width between property lines of every way or place of any nature when any part of it is open to the use of the public as a matter of right for vehicular travel. See Utah Code 41-6a-102
- Operate: means the same as that term is defined in Section
41-1a-102 . See Utah Code 41-6a-102 - Person: means a natural person, firm, copartnership, association, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, governmental agency, public corporation, or any other legal or commercial entity. See Utah Code 41-6a-102
- Roadway: means that portion of highway improved, designed, or ordinarily used for vehicular travel. See Utah Code 41-6a-102
- Traffic: means pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any highway for the purpose of travel. See Utah Code 41-6a-102
(1)(a) when necessary to comply with signals affecting the safety of the movement of trains;
(1)(b) when necessary to avoid striking any object or person on the track;
(1)(c) when the train is disabled;
(1)(d) when the train is in motion or while engaged in switching operations;
(1)(e) when there is no vehicular traffic waiting to use the crossing;
(1)(f) when necessary to comply with a governmental safety regulation; or
(1)(g) as determined by a highway authority.
(2) A violation of this section is an infraction.
