(1) The department shall develop and implement a statewide tracking system that contains the following information for all sexual assault kits collected by law enforcement:

- Bureau: means the Bureau of Criminal Identification within the department, created in Section 53-10-201. See Utah Code 53-10-102
- Collecting facility: means a hospital, health care facility, or other facility that performs sexual assault examinations. See Utah Code 53-10-902
- Department: means the Department of Public Safety. See Utah Code 53-10-902
- Forensic: means dealing with the application of scientific knowledge relating to criminal evidence. See Utah Code 53-10-102
- Sexual assault kit: means a package of items that is used by medical personnel to gather and preserve biological and physical evidence following an allegation of a sexual offense. See Utah Code 53-10-902
- Victim: means an individual against whom a sexual offense has been committed or allegedly been committed. See Utah Code 53-10-902
(1)(a) the submission status of sexual assault kits by law enforcement to the Utah Bureau of Forensic Services;
(1)(b) notification by the Utah Bureau of Forensic Services to law enforcement of DNA analysis findings; and
(1)(c) the storage location of sexual assault kits.
(2) The tracking system shall include a secure electronic access that allows the submitting agency, collecting facility, department, and a victim, or his or her designee, to access or receive information, provided that the disclosure does not impede or compromise an active investigation, about the:
(2)(a) lab submission status;
(2)(b) DNA analysis findings provided to law enforcement; and
(2)(c) storage location of a sexual assault kit that was gathered from that victim.
