(1) A peace officer may not restrain a person by the application of a knee applying pressure to the neck or throat of a person.

Terms Used In Utah Code 53-13-115

  • Council: means the Peace Officer Standards and Training Council created in Section 53-6-106. See Utah Code 53-13-101
  • Peace officer: means any officer certified in accordance with Title 53, Chapter 13, Peace Officer Classifications. See Utah Code 53-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) A violation of this section shall be referred separately to the county or district attorney for review, and to the Peace Officer Standards and Training Council for investigation.
(3) A violation of this section is a third degree felony.
(4) If the violation results in:

     (4)(a) serious bodily injury or loss of consciousness, it is a second degree felony; or
     (4)(b) death, it is a first degree felony.
