Terms Used In Utah Code 53-25-501

  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 53-1-102
  • Law enforcement agency: means an entity or division of:
              (1)(e)(i)
                   (1)(e)(i)(A) the federal government, a state, or a political subdivision of a state;
                   (1)(e)(i)(B) a state institution of higher education; or
                   (1)(e)(i)(C) a private institution of higher education, if the entity or division is certified by the commissioner under Title 53, Chapter 19, Certification of Private Law Enforcement Agency; and
              (1)(e)(ii) that exists primarily to prevent and detect crime and enforce criminal laws, statutes, and ordinances. See Utah Code 53-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) “Commission” means the State Commission on Criminal and Juvenile Justice created in Section 63M-7-201.
     (1)(b) “Firearm” means the same as that term is defined in Section 76-10-501.
     (1)(c) “Restricted person” means a Category I or Category II restricted person as defined in Section 76-10-503.
(2) Beginning on July 1, 2026, a law enforcement agency, not including the Department of Corrections, shall annually on or before April 30 report to the commission the following data for the previous calendar year:

     (2)(a) the number of firearms the law enforcement agency lawfully seized from restricted persons;
     (2)(b) the types of firearms the law enforcement agency lawfully seized from restricted persons;
     (2)(c) information on where the restricted persons obtained the firearms seized by the law enforcement agency if the information is known or discoverable by the law enforcement agency; and
     (2)(d) the reasons under Subsection 76-10-503(1)(a) or (b) that made the individuals who had weapons seized restricted persons.
