Terms Used In Utah Code 53-7-310
- Board: means the Liquefied Petroleum Gas Board created in Section
53-7-304 . See Utah Code 53-7-302 - Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Licensee: means a person licensed by the board to engage in the liquefied petroleum gas business. See Utah Code 53-7-302
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means any individual, firm, partnership, joint venture, association, corporation, estate, trust, or any other group or combination acting as a unit, and includes:(13)(a) a husband, wife, or both where joint benefits are derived from the operation of a business or activity subject to this part; and(13)(b) any state, county, municipality, or other agency engaged in a business or activity subject to this part. See Utah Code 53-7-302
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(1)(a) A license issued under this part shall state the name of the person or persons to whom it is issued.(1)(b) The license shall specify the location, by street and number, of the premises for which it is issued and the particular classification of the license authorizing the type of staffed plant or facility to be conducted.(1)(c) The registration of additional staffed plants or facilities, under Subsection53-7-309(2) , shall specify the location, by street and number, of the premises for which it is issued and the particular classification of the license authorizing the type of business to be conducted.

(2)(a) Any license issued under this part is not transferable by the licensee or licensees to any other person, firm, association, partnership, or corporation, and is valid only for the particular premises and particular persons described on the license.
(2)(b) If there is any transfer or change in the ownership, the change shall be reported to the board within 30 days.
(2)(c) A license or registration fee paid under this part may not be refunded when any license issued is no longer valid because of:
(2)(c)(i) a voluntary transfer of any nature;
(2)(c)(ii) revocation under this part;
(2)(c)(iii) death of the holder;
(2)(c)(iv) insolvency;
(2)(c)(v) assignment for the benefit of creditors; or
(2)(c)(vi) for any other reason determined by rule of the board.
