(1) There is created a restricted account within the General Fund known as the Motor Vehicle Safety Impact Restricted Account.
Terms Used In Utah Code 53-8-214
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Division: means the Utah Highway Patrol Division created in Section
53-8-103 . See Utah Code 53-8-102 - Highway: includes :(15)(a) a public bridge;(15)(b) a county way;(15)(c) a county road;(15)(d) a common road; and(15)(e) a state road. See Utah Code 68-3-12.5
- Highway Patrol: means the Highway Patrol troopers employed under Section
53-8-104 . See Utah Code 53-8-102- Motor vehicle: means every self-propelled vehicle and every vehicle propelled by electric power obtained from overhead trolley wires, but not operated upon rails, except motorized wheel chairs and vehicles moved solely by human power. See Utah Code 53-1-102
- Vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Utah Code 53-1-102
(2) The account includes:(2)(a) deposits made to the restricted account from registration fees as described in Subsection 41-1a-1201(7);(2)(b) donations or deposits made to the account; and(2)(c) any interest earned on the account.(3) Upon appropriation, the division may use funds in the account to improve motor vehicle safety, mitigate impacts, and enforce safety provisions, including the following:(3)(a) hiring new Highway Patrol troopers;(3)(b) payment of overtime for Highway Patrol troopers; and(3)(c) acquisition of equipment to improve motor vehicle safety impacts and enforcement.(4) The division shall annually report to the Executive Offices and Criminal Justice Appropriations Subcommittee to justify expenditures and use of funds in the account. - Highway Patrol: means the Highway Patrol troopers employed under Section
