(1) As used in this section, “account” means the Utah Highway Patrol Aero Bureau Restricted Account created by this section.

Terms Used In Utah Code 53-8-303

  • Division: means the Utah Highway Patrol Division created in Section 53-8-103. See Utah Code 53-8-102
  • Highway: includes :
         (15)(a) a public bridge;
         (15)(b) a county way;
         (15)(c) a county road;
         (15)(d) a common road; and
         (15)(e) a state road. See Utah Code 68-3-12.5
  • Highway Patrol: means the Highway Patrol troopers employed under Section 53-8-104. See Utah Code 53-8-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) There is created a restricted account in the General Fund known as the “Utah Highway Patrol Aero Bureau Restricted Account.”
(3) The account shall consist of:

     (3)(a) money deposited into the account in accordance with Section 41-22-19;
     (3)(b) money appropriated to the account by the Legislature; and
     (3)(c) any other public or private money received by the division that is:

          (3)(c)(i) given to the division for purposes consistent with this section; and
          (3)(c)(ii) deposited into the account at the request of:

               (3)(c)(ii)(A) the division; or
               (3)(c)(ii)(B) the person giving the money.
(4) Money in the account may only be expended for:

     (4)(a) the purchase of aircraft and helicopters for use by the Aero Bureau in search and rescue operations;
     (4)(b) replacement, maintenance, and upgrade of search and rescue equipment;
     (4)(c) search and rescue training and certification for division officers and employees;
     (4)(d) personnel and fuel costs of the Aero Bureau associated with providing search and rescue services; and
     (4)(e) any other equipment or expenses necessary or appropriate for conducting search and rescue activities.
