Terms Used In Utah Code 53B-8a-203

  • Donation: means a gift, grant, donation, or any other conveyance of money by a person other than the Legislature that is not made directly for the benefit or on behalf of a particular individual. See Utah Code 53B-8a-201
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Plan: means the Utah Educational Savings Plan created in Section 53B-8a-103. See Utah Code 53B-8a-102
  • Program: means the Student Prosperity Savings Program created in Section 53B-8a-202. See Utah Code 53B-8a-201
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) A person may make a donation to the program by:

          (1)(a)(i) sending the donation to the plan; and
          (1)(a)(ii) including with the donation, direction that the donation benefit the program.
     (1)(b) A person making a donation shall include the person’s name and mailing address with the donation.

     (2)(a) The plan shall mail a receipt to the person that makes the donation.
     (2)(b) The receipt described in Subsection (2)(a) shall state:

          (2)(b)(i) the name of the person that made the donation;
          (2)(b)(ii) the amount of the donation; and
          (2)(b)(iii) the date on which the person makes the donation.
     (2)(c) The date on which the person makes a donation to the program is the date on which the plan receives the donation, unless the plan receives the donation on a Saturday, a Sunday, or a holiday, in which case the date on which the person makes the donation shall be the first business day after the day on which the plan receives the donation.
