Terms Used In Utah Code 53F-4-306
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(1)(a) The state board shall require a private school to submit a signed affidavit assuring the private school will comply with the requirements of this part.
(1)(b) If a school fails to submit a signed affidavit within 30 days of receiving notification that the school is an approved private school to receive the Carson Smith Scholarship, the state board may:
(1)(b)(i) deny the private school permission to enroll scholarship students; and
(1)(b)(ii) interrupt disbursement of or withhold scholarship payments.
(2) The state board may investigate complaints and convene administrative hearings for an alleged violation of this part.
(3) Upon a finding that this part was violated, the state board may:
(3)(a) deny a private school permission to enroll scholarship students;
(3)(b) interrupt disbursement of or withhold scholarship payments; or
(3)(c) issue an order for repayment of scholarship payments fraudulently obtained.
