(1) A school shall require written parental consent for student participation in all curricular and noncurricular clubs at the school.

Terms Used In Utah Code 53G-7-708

  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Club: means any student organization that meets during noninstructional time. See Utah Code 53G-7-701
  • Noncurricular club: is a student initiated group that may be authorized and allowed school facilities use during noninstructional time in secondary schools by a school and LEA governing board in accordance with the provisions of this part. See Utah Code 53G-7-701
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • School: means a public school, including a charter school. See Utah Code 53G-7-701
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) Membership in curricular clubs is governed by the following:

     (2)(a)

          (2)(a)(i) membership may be limited to students who are currently attending the sponsoring school or school district; and
          (2)(a)(ii) members who attend a school other than the sponsoring school shall have, in addition to the consent required under Section 53G-7-709, specific parental permission for membership in a curricular club at another school;
     (2)(b)

          (2)(b)(i) curricular clubs may require that prospective members try out based on objective criteria outlined in the application materials; and
          (2)(b)(ii) try-outs may not require activities that violate the provisions of this part and other applicable laws, rules, and policies; and
     (2)(c) other rules or policies as determined by the state board, school district, or school.
(3) Membership in noncurricular clubs is governed by the following:

     (3)(a) student membership in a noncurricular club is voluntary;
     (3)(b) membership shall be limited to students who are currently attending the school;
     (3)(c)

          (3)(c)(i) noncurricular clubs may require that prospective members try out based on objective criteria outlined in the application materials; and
          (3)(c)(ii) try-outs may not require activities that violate the provisions of this part and other applicable laws, rules, and policies;
     (3)(d) a copy of any written or other media materials that were presented at a noncurricular club meeting by a nonschool person shall be delivered to a school administrator no later than 24 hours after the noncurricular club meeting and, if requested, a student’s parent shall have an opportunity to review those materials; and
     (3)(e) other rules or policies as determined by the state board, school district, or school.
