(1) A person is guilty of criminal trespass upon school property if the person does the following:

  • Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • real property: includes :
         (31)(a) land;
         (31)(b) a tenement;
         (31)(c) a hereditament;
         (31)(d) a water right;
         (31)(e) a possessory right; and
         (31)(f) a claim. See Utah Code 68-3-12.5
     (1)(a) enters or remains unlawfully upon school property, and:

          (1)(a)(i) intends to cause annoyance or injury to a person or damage to property on the school property;
          (1)(a)(ii) intends to commit a crime; or
          (1)(a)(iii) is reckless as to whether the person’s presence will cause fear for the safety of another; or
     (1)(b) enters or remains without authorization upon school property if notice against entry or remaining has been given by:

          (1)(b)(i) personal communication to the person by a school official or an individual with apparent authority to act for a school official;
          (1)(b)(ii) the posting of signs reasonably likely to come to the attention of trespassers;
          (1)(b)(iii) fencing or other enclosure obviously designed to exclude trespassers; or
          (1)(b)(iv) a current order of suspension or expulsion.
(2) As used in this section:

     (2)(a) “Enter” means intrusion of the entire body.
     (2)(b) “School official” means a public or private school administrator or person in charge of a school program or activity.
     (2)(c) “School property” means real property owned or occupied by a public or private school, including real property temporarily occupied for a school activity or program.
(3) Violation of this section is a class B misdemeanor.
