(1) As used in this section:
Terms Used In Utah Code 57-8-6.7
- association: means all of the unit owners:(2)(a) acting as a group in accordance with the declaration and bylaws; or(2)(b) organized as a legal entity in accordance with the declaration. See Utah Code 57-8-3
- Unit: includes one or more rooms or spaces located in one or more floors or a portion of a floor in a building. See Utah Code 57-8-3
(1)(a) “Plan fee” means a fee that an association of unit owners charges for review and approval of unit plans.(1)(b) “Unit plans” means plans:(1)(b)(i) for the construction or improvement of a unit; and(1)(b)(ii) that are required to be approved by the association of unit owners before the unit construction or improvement may occur.
(2) An association of unit owners may not charge a plan fee that exceeds the actual cost of reviewing and approving the unit plans.
