In addition to the conduct described in Subsection
(1) practicing physical therapy, unless the person:
Terms Used In Utah Code 58-24b-501
- Animal physical therapy: means practicing physical therapy or physiotherapy on an animal. See Utah Code 58-24b-102
- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102 - Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Licensed physical therapist: means a person licensed under this chapter to engage in the practice of physical therapy. See Utah Code 58-24b-102
- Licensed physical therapist assistant: means a person licensed under this chapter to engage in the practice of physical therapy, subject to the provisions of Subsection 58-24b-401(2)(a). See Utah Code 58-24b-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5(1)(a) is licensed under this chapter to practice physical therapy and practices within the scope of that license; or(1)(b) is exempt from licensure under Section
58-24b-304 ;
(2) practicing animal physical therapy, unless the person is:
(2)(a) authorized to practice animal physical therapy under Section 58-24b-405 ; or
(2)(b) authorized to practice animal physical therapy under Subsection 58-24b-304(1)(a) , (2) , or (3) ;
(3) representing oneself as, or using the title of, a physical therapist, unless the person is:
(3)(a) a licensed physical therapist; or
(3)(b)
(3)(b)(i) licensed as a physical therapist in a jurisdiction other than Utah;
(3)(b)(ii) does not represent oneself as being a physical therapist licensed in Utah; and
(3)(b)(iii) exempt from licensure under Section 58-24b-304 ;
(4) representing oneself as, or using the title of, a physical therapist assistant, unless the person:
(4)(a) is a licensed physical therapist assistant; or
(4)(b)
(4)(b)(i) is licensed as a physical therapist assistant in a jurisdiction other than Utah;
(4)(b)(ii) does not represent oneself as being a physical therapist assistant licensed in Utah; and
(4)(b)(iii) is exempt from licensure under Section 58-24b-304 ; and
(5) conduct designated as “unlawful conduct” by the division, by rule.
