(1) A licensee under this chapter may not disclose information about the licensee’s care of an animal to anyone other than the client, as defined in Section 58-28-102 , unless:
Terms Used In Utah Code 58-28-605
- Animal: means any animal other than a human. See Utah Code 58-28-102
- Client: means the patient's owner, the owner's agent, or other person responsible for the patient. See Utah Code 58-28-102
- Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Subpoena: A command to a witness to appear and give testimony.
- Veterinarian: means an individual licensed under this chapter to engage in the practice of veterinary medicine, surgery, and dentistry. See Utah Code 58-28-102
- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5(1)(a) the client consents to the disclosure in writing;(1)(b) disclosure to public health officials, animal health or welfare officials, agricultural authorities, or federal, state, or local officials is required, or necessary to protect the animal or to protect public health;(1)(c) disclosure is required by court order or subpoena; or(1)(d) the client has placed the veterinarian‘s care or treatment of the animal or the nature or extent of injuries to the animal at issue in a civil or criminal proceeding.(2) A licensee who releases medical records under the provisions of this section is not liable to the client or any other person for the release of the records.
