(1) As used in this section, “division” means the Criminal Investigations and Technical Services Division of the Department of Public Safety, created in Section 53-10-103.

Terms Used In Utah Code 58-37d-9

  • Department: means the Department of Commerce. See Utah Code 58-1-102
  • Division: means the Division of Professional Licensing created in Section 58-1-103. See Utah Code 58-1-102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) The division has authority to enforce this chapter. To carry out this purpose, the division may:

     (2)(a) assist the law enforcement agencies of the state in enforcing this chapter;
     (2)(b) conduct investigations to enforce this chapter;
     (2)(c) present evidence obtained from investigations conducted in conjunction with appropriate county and district attorneys and the Office of the Attorney General for civil or criminal prosecution or for administrative action against a licensee; and
     (2)(d) work in cooperation with the Division of Professional Licensing, created under Section 58-1-103, to accomplish the purposes of this section.
