A professional geologist may only affix the licensee‘s seal to a geologic map, cross-section, sketch, drawing, plan, or report if the geologic map, cross-section, sketch, drawing, plan, or report:

(1) was personally prepared by the licensee;

Terms Used In Utah Code 58-76-603

  • Board: means the Professional Geologist Licensing Board created in Section 58-76-201. See Utah Code 58-76-102
  • Division: means the Division of Professional Licensing created in Section 58-1-103. See Utah Code 58-1-102
  • Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Professional geologist: means a person licensed under this chapter to engage in the practice of geology before the public. See Utah Code 58-76-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Subordinate: means any individual who practices geology or assists a professional geologist in the practice of geology before the public without assuming the responsible charge for the work. See Utah Code 58-76-102
(2) was prepared by an employee, subordinate, associate, or drafter under the supervision of a licensee, provided the licensee or a principal affixing his seal assumes responsibility;
(3) was prepared by a licensed professional geologist in this state or any other state provided:

     (3)(a) the licensee in this state affixing the seal performs a thorough review of all work for compliance with all applicable laws and rules and the standards of the profession; and
     (3)(b) makes any necessary corrections before submitting the final plan, specification, or report:

          (3)(b)(i) to a public authority; or
          (3)(b)(ii) to a client who has contracted with a professional geologist for the geologic map, cross-section, or report to be complete and final;
(4) was prepared in part by a licensed professional geologist in this state or any other state provided:

     (4)(a) the licensee in this state clearly identifies that portion of the geologic map, cross-section, or report for which the licensee is responsible;
     (4)(b) the licensee in this state affixing the seal performs a thorough review of that portion of the geologic map, cross-section, or report for which the licensee is responsible for compliance with the standards of the profession; and
     (4)(c) makes any necessary corrections before submitting the final geologic map, cross-section, or report for which the licensee is responsible:

          (4)(c)(i) to a public authority; or
          (4)(c)(ii) to a client who has contracted with a professional geologist for the geologic map, cross-section, or report to be complete and final;
(5) was prepared by a person exempt from licensure as a professional geologist provided that:

     (5)(a) the licensee in this state affixing the seal performs a thorough review for compliance with all applicable laws and rules and the standards of the profession; and
     (5)(b) makes any necessary corrections before submitting the final geologic map, cross-section, or report:

          (5)(b)(i) to a public authority; or
          (5)(b)(ii) to a client who has contracted with a professional geologist for the geologic map, cross-section, or report to be complete and final; or
(6) meets any additional requirements established by rule by the division in collaboration with the board.
