(1) When the division is served a petition under Section 61-2f-506, the division may:

Terms Used In Utah Code 61-2f-507

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Division: means the Division of Real Estate. See Utah Code 61-2f-102
  • Person: means an individual or entity. See Utah Code 61-2f-102
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
     (1)(a) file an answer to the petition in the court;
     (1)(b) initiate a review proceeding conducted by the division; or
     (1)(c) appear in any proceeding in the name of the defendant to the action or on behalf of the fund.
(2) The division may settle a claim against the fund if:

     (2)(a) the person who brings the claim requests a settlement; and
     (2)(b) the court in which the petition is filed approves the settlement.
