(1) Except as provided in Subsection (2), while a complaint is under review by the Legislature, a member of the commission may not comment publicly or privately about the commission’s decision, reasoning, or other matters relating to the ethics complaint, but may provide or refer a questioner to the commission’s written finding.

Terms Used In Utah Code 63A-14-606

  • Commission: means the Independent Executive Branch Ethics Commission, created in Section 63A-14-202. See Utah Code 63A-14-102
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
(2) Subsection (1) does not prohibit statements made:

     (2)(a) to an individual authorized by the Legislature to conduct an investigation for the purpose of assisting the Legislature in conducting proceedings related to impeachment or removal from office;
     (2)(b) to a legislative committee, the House, or the Senate in relation to proceedings for impeachment or trial of impeachment; or
     (2)(c) as part of a criminal investigation.
