Terms Used In Utah Code 63A-3-502.5

  • Accounts receivable: includes :
              (1)(b)(i) unpaid fees, licenses, taxes, loans, overpayments, fines, forfeitures, surcharges, costs, contracts, interest, penalties, third-party claims, sale of goods, sale of services, claims, and damages;
              (1)(b)(ii) a civil accounts receivable; and
              (1)(b)(iii) a civil judgment of restitution. See Utah Code 63A-3-501
  • Agency: means a board, commission, institution, department, division, officer, council, office, committee, bureau, or other administrative unit of the state, including the agency head, agency employees, or other persons acting on behalf of or under the authority of the agency head, the Legislature, the courts, or the governor, but does not mean a political subdivision of the state, or any administrative unit of a political subdivision of the state. See Utah Code 63A-1-103
  • Criminal accounts receivable: means the same as that term is defined in Section 77-32b-102. See Utah Code 63A-3-501
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Office: means the Office of State Debt Collection created in Section 63A-3-502. See Utah Code 63A-3-501
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) an accounts receivable; or
     (1)(b) a criminal accounts receivable.
(2) On or before December 31, 2022, the office shall provide a debtor who has a debt transferred to the office online access to the debtor’s account that identifies:

     (2)(a) the total balance the debtor owes for a debt;
     (2)(b)

          (2)(b)(i) each person to whom the debtor owes a debt; or
          (2)(b)(ii) if the person’s name is redacted by a court or a state agency with authority to redact, another identifier for the debt in place of the person’s name;
     (2)(c) for each person the debtor owes:

          (2)(c)(i) the debtor’s original balance for a debt; and
          (2)(c)(ii) the debtor’s current balance for a debt;
     (2)(d) the current interest rate for a debt; and
     (2)(e) the history of:

          (2)(e)(i) any additional charge added to a debt including:

               (2)(e)(i)(A) the reason for the charge;
               (2)(e)(i)(B) the total amount of the charge; and
               (2)(e)(i)(C) the date the charge was added; and
          (2)(e)(ii) any payment made by the debtor including:

               (2)(e)(ii)(A) the debt to which a payment was applied; and
               (2)(e)(ii)(B) whether the payment was applied to an administrative cost, accrued interest, the principal, or other fee.
