(1) As used in this section, “maintenance functions” means all programs and activities related to the operation and maintenance of a state facility, including preventive maintenance and inspection.

Terms Used In Utah Code 63A-5b-701

  • Agency: means a board, commission, institution, department, division, officer, council, office, committee, bureau, or other administrative unit of the state, including the agency head, agency employees, or other persons acting on behalf of or under the authority of the agency head, the Legislature, the courts, or the governor, but does not mean a political subdivision of the state, or any administrative unit of a political subdivision of the state. See Utah Code 63A-1-103
  • Director: means the division director, appointed under Section 63A-5b-302. See Utah Code 63A-5b-102
  • Division: means the Division of Facilities Construction and Management created in Section 63A-5b-301. See Utah Code 63A-5b-102
  • Institution of higher education: means an institution listed in Subsection 53B-2-101(1). See Utah Code 63A-5b-102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5

     (2)(a) The director shall direct or delegate maintenance functions for an agency, except for:

          (2)(a)(i) the State Capitol Preservation Board; and
          (2)(a)(ii) an institution of higher education.
     (2)(b) The director may delegate responsibility for maintenance functions to an agency only if:

          (2)(b)(i) the agency requests the responsibility; and
          (2)(b)(ii) the director determines that:

               (2)(b)(ii)(A) the agency has the necessary resources and skills to comply with maintenance functions standards approved by the director; and
               (2)(b)(ii)(B) the delegation would result in net cost savings to the state as a whole.
     (2)(c) The State Capitol Preservation Board and an institution of higher education are exempt from division oversight of maintenance functions.
     (2)(d) An institution of higher education shall comply with the division’s facility maintenance functions standards.
(3)

     (3)(a) An institution of higher education shall annually report to the division, in a format required by the division, on the institution of higher education’s compliance with the division’s maintenance functions standards.
     (3)(b) The division shall:

          (3)(b)(i) prescribe a standard format for reporting compliance with the division’s maintenance functions standards;
          (3)(b)(ii) report to the Legislature on the compliance or noncompliance with the standards; and
          (3)(b)(iii) conduct periodic audits to ensure that institutions of higher education are complying with the standards and report the results of the audits to the Legislature.
