(1) A permit holder may not file for or receive unemployment benefits.

Terms Used In Utah Code 63G-12-211

  • Department: means the Department of Public Safety created in Section 53-1-103. See Utah Code 63G-12-102
  • Guest worker: means an undocumented individual who holds a guest worker permit. See Utah Code 63G-12-102
  • Permit: means a permit issued under Part 2, Guest Worker Program, and includes:
         (12)(a) a guest worker permit; and
         (12)(b) an immediate family permit. See Utah Code 63G-12-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) A person may not:

     (2)(a) furnish false or forged information or documentation in support of an application;
     (2)(b) alter the information on a permit;
     (2)(c) if the person is a guest worker, be reported absent from work for 10 consecutive days without the approval of the person who hires the guest worker;
     (2)(d) allow an individual to use a permit if the individual is not entitled to use the permit;
     (2)(e) display or represent that a permit is issued to an individual, if the permit is not issued to the individual;
     (2)(f) display a revoked permit as a valid permit;
     (2)(g) knowingly or with reckless disregard acquire, use, display, or transfer an item that purports to be a valid permit, but that is not a valid permit; or
     (2)(h) otherwise violate this part.
(3) For a violation described in Subsections (1) and (2), the department may:

     (3)(a) suspend, limit, or revoke and repossess a permit;
     (3)(b) impose a civil penalty not to exceed $750 for each violation; or
     (3)(c) take a combination of actions under this section.
(4) A person is guilty of a class B misdemeanor if the person:

     (4)(a) furnishes false or forged information or documentation in support of an application; or
     (4)(b) alters the information on a permit.
