(1) As used in this section:
Terms Used In Utah Code 63G-2-901
- Person: means :(17)(a) an individual;(17)(b) a nonprofit or profit corporation;(17)(c) a partnership;(17)(d) a sole proprietorship;(17)(e) other type of business organization; or(17)(f) any combination acting in concert with one another. See Utah Code 63G-2-103
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(1)(a) “Public association” means any association, organization, or society whose members include elected or appointed public officials and for which public funds are used or paid to the public association for membership dues or for other support for the official’s participation in the public association.(1)(b)(1)(b)(i) “Public funds” means any money received by a public entity from appropriations, taxes, fees, interest, or other returns on investment.(1)(b)(ii) “Public funds” does not include money donated to a public entity by a person or entity.
(2) The budget documents and financial statements of a public association shall be released pursuant to a written request if 50% or more of the public association’s:
(2)(a) members are elected or appointed public officials from this state; and
(2)(b) membership dues or other financial support come from public funds from this state.
