A person that seeks to have a local government create a project area under this part, and to be a project participant within that project area, shall provide a local government with a written application that certifies that the applicant:

(1) is a party to a franchise agreement;

Terms Used In Utah Code 63N-3-1404

  • Franchise agreement: means a legally binding and valid agreement under which:
         (2)(a) a major professional sports league has awarded a franchise to a franchise recipient; and
         (2)(b) the major professional sports league team that is the subject of the agreement is playing, or will play, home games in a qualified stadium that exists or will be constructed within the project area. See Utah Code 63N-3-1401
  • Land: includes :
         (18)(a) land;
         (18)(b) a tenement;
         (18)(c) a hereditament;
         (18)(d) a water right;
         (18)(e) a possessory right; and
         (18)(f) a claim. See Utah Code 68-3-12.5
  • Local government: means the municipality in which the project area is located. See Utah Code 63N-3-1401
  • Major professional sports league: means the National Basketball Association or the National Hockey League. See Utah Code 63N-3-1401
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Project area: means the area created and designated to receive funds and revenue according to the terms and requirements of this part. See Utah Code 63N-3-1401
  • Project participant: means a person that is approved to participate in the use of public funds in a project area according to the procedures and requirements of this part. See Utah Code 63N-3-1401
  • Qualified stadium: means a sports facility that:
         (7)(a) provides seating for spectators in a number that is reasonably consistent with the capacity of other stadiums used by other teams in the major professional sports league;
         (7)(b) is located within the project area; and
         (7)(c)
              (7)(c)(i) is in active use as the home venue of a major professional sports league team; or
              (7)(c)(ii) in the case of a stadium that is proposed to be constructed or remodeled, will be the home venue of a major professional sports league. See Utah Code 63N-3-1401
(2) is or will be operating the team that is subject to the franchise agreement:

     (2)(a) in an existing qualified stadium located within the project area to be created; or
     (2)(b) in a new qualified stadium that will be located within the project area;
(3) shows the existing and, as applicable, the proposed location and footprint of the qualified stadium;
(4) lists any public funds that are currently being received by, or are authorized to be received by:

     (4)(a) the applicant; or
     (4)(b) any major professional sports league team that is owned or operated by the applicant; and
(5) any proposals or information related to the application, including specific details about the franchise agreement or plans for a qualified stadium, a proposed boundary for the project area, proposals for land or stadium ownership arrangements or stadium revenue-sharing arrangements, or plans or requests for urban renewal or reconstruction.
