(1) As used in this section, “participating county” means a county that participates in a cooperative agreement with the division, as described in Section 65A-8-203.
Terms Used In Utah Code 65A-8-209.1
- Division: means the Division of Forestry, Fire, and State Lands. See Utah Code 65A-1-1
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5

(2)(a) A county fire warden who is employed by the division as a county fire warden full-time and year round shall represent a participating county, except as provided in Subsections (2)(b) and (c).
(2)(b) A county of the fifth class that, as of January 1, 2016, is cost-sharing a county fire warden with an adjacent county may continue to do so with the approval of the state forester.
(2)(c) A county of the sixth class may cost-share a county fire warden with an adjacent county, with the approval of the state forester.

(3)(a) The salary and benefits paid to a county fire warden shall be:
(3)(a)(i) divided by the division and the county; or
(3)(a)(ii) paid partly by the division with the remainder shared by agreement between the counties the county fire warden represents.
(3)(b) The division may annually increase the amount agreed to for the county portion if:
(3)(b)(i) the increase takes effect at the beginning of a calendar year;
(3)(b)(ii) the division provides the participating county six months notice before the increase takes effect; and
(3)(b)(iii) the increase is based on the Consumer Price Index for All Urban Consumers as published by the Bureau of Labor Statistics of the United States Department of Labor, in accordance with a formula established by the division by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.

(4)(a) The division shall employ the county fire wardens.
(4)(b) An individual who is employed by a county as a county fire warden on or before January 1, 2016, is not subject to the requirement to be employed by the division.
