Terms Used In Utah Code 65A-8-213

  • Division: means the Division of Forestry, Fire, and State Lands. See Utah Code 65A-1-1
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Wildland: means an area where:
         (9)(a) development is essentially non-existent, except for roads, railroads, powerlines, or similar transportation facilities; and
         (9)(b) structures, if any, are widely scattered. See Utah Code 65A-1-1
  • Wildland fire: means a fire that consumes:
         (10)(a) wildland; or
         (10)(b) wildland-urban interface, as defined in Section 65A-8a-102. See Utah Code 65A-1-1
     (1)(a) There is created an expendable special revenue fund known as the “Wildland Fire Preparedness Grants Fund.”
     (1)(b) The Wildland Fire Preparedness Grants Fund shall consist of:

          (1)(b)(i) voluntary contributions received;
          (1)(b)(ii) appropriations the Legislature makes to the Wildland Fire Preparedness Grants Fund;
          (1)(b)(iii) 10% of the costs recovered annually related to wildfire suppression described in Subsections 65A-8-204(3)(f) and (g); and
          (1)(b)(iv) interest or other earnings accrued in accordance with Subsection (1)(c)(ii).
     (1)(c) The state treasurer shall:

          (1)(c)(i) invest the money in the Wildland Fire Preparedness Grants Fund described in Subsection (1)(a) following the procedures and requirements of Title 51, Chapter 7, State Money Management Act; and
          (1)(c)(ii) deposit all interest or other earnings derived from each investment described in Subsection (1)(c)(i) into the Wildland Fire Preparedness Grants Fund.

     (2)(a) The state forester shall make one or more grants from the Wildland Fire Preparedness Grants Fund to one or more local fire departments or volunteer fire departments to assist in building capacity for the suppression of wildland fire.
     (2)(b) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the division shall make rules establishing criteria for receiving a grant under this section.
