Terms Used In Utah Code 70C-2-203
- Dwelling: means a residential structure attached to real property that contains one to four units including any of the following if used as a residence:(5)(a) a condominium unit;(5)(b) a cooperative unit;(5)(c) a manufactured home; or(5)(d) a house. See Utah Code 70C-1-302
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
A lessor, in order to secure the debt arising from a consumer lease, may not take a security interest in the dwelling of the lessee. A security interest taken in violation of this section is void from its inception.
