Terms Used In Utah Code 72-10-109
- Aircraft: means any contrivance now known or in the future invented, used, or designed for navigation of or flight in the air. See Utah Code 72-10-102
- Civil aircraft: means any aircraft other than a public aircraft. See Utah Code 72-10-102
- Commission: means the Transportation Commission created under Section 72-1-301. See Utah Code 72-1-102
- Department: means the Department of Transportation created in Section 72-1-201. See Utah Code 72-1-102
- Flight: means any kind of locomotion by aircraft while in the air. See Utah Code 72-10-102
- Person: means any individual, corporation, limited liability company, or association of individuals. See Utah Code 72-10-102
- Pilot: means any person who operates the controls of an aircraft while in-flight. See Utah Code 72-10-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Unmanned aircraft: means an aircraft that is:(37)(a) capable of sustaining flight; and(37)(b) operated with no possible direct human intervention from on or within the aircraft. See Utah Code 72-10-102(1)(a) A person may not operate, pilot, or navigate, or cause or authorize to be operated, piloted, or navigated within this state any civil aircraft domiciled in this state unless the aircraft has a current certificate of registration issued by the department.(1)(b) The restriction described in Subsection (1)(a) does not apply to aircraft licensed by a foreign country with which the United States has a reciprocal agreement covering the operations of the registered aircraft or to a non-passenger-carrying flight solely for inspection or test purposes authorized by the Federal Aviation Administration to be made without the certificate of registration.
(2) Aircraft centrally assessed by the State Tax Commission are exempt from the state registration requirement under Subsection (1).
(3) Beginning on January 1, 2024, a person may not operate in this state an unmanned aircraft system or an advanced air mobility aircraft for commercial operation for which certification is required under 14 C.F.R. Part 107 or 135 unless the aircraft has a current certificate of registration issued by the department.
