(1) There is created an enterprise fund known as the “Water Infrastructure Fund,” which is referred to in this section as the “fund.”
Terms Used In Utah Code 73-10g-107
- Division: means the Division of Water Resources. See Utah Code 73-10g-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) The fund shall consist of:(2)(a) appropriations from the Legislature;(2)(b) money from the federal government;(2)(c) grants or donations from a person;(2)(d) money made available to the state for purposes of water infrastructure projects from any source;(2)(e) money received for the repayment of loans made from the fund; and(2)(f) interest and earnings on the fund.(3) The state treasurer shall invest the money in the fund according to Title 51, Chapter 7, State Money Management Act, except that interest or other earnings derived from those investments shall be deposited into the fund.(4)(4)(a) The Water Development Coordinating Council may use money in the fund to pay for the costs of administering Part 6, Planning and Prioritization, including staff directly related to the activities of the Water Development Coordinating Council under Part 6, Planning and Prioritization.(4)(b) The division may use money in the fund to pay for the costs of the study required by Section73-10-39 .(4)(c) Fund money may be used to issue loans or grants prioritized in accordance with Section73-10g-603 .
