(1) As used in this section, “reason to believe” means information from which a reasonable person would believe that the person may have been involved in an accident.
Terms Used In Utah Code 73-18-13.3
- Operator: means the person who is in control of a vessel while it is in use. See Utah Code 73-18-2
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- Vessel: means every type of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water. See Utah Code 73-18-2
(2)(2)(a) The operator of a vessel who has reason to believe that the operator may have been involved in an accident resulting in the death of a person shall:(2)(a)(i) immediately stop the vessel at the scene of the accident or as close to it as safely possible; and(2)(a)(ii) remain at the scene of the accident until the operator has fulfilled the requirements of Section73-18-13 .(2)(b) If the operator of a vessel has reason to believe the operator may have been involved in an accident only after leaving the scene of the accident, the operator shall immediately comply as nearly as possible with the requirements of Section73-18-13 .(3) A person who violates the provisions of Subsection(2) is guilty of a third degree felony and shall be fined not less than $750.
