For purposes of this chapter, the Division of Water Resources:
(1) shall provide for the construction, operation, and maintenance of the West Desert Pumping Project;

- Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Land: includes :(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) may enter into agreements as necessary to provide for all or any portion of the West Desert Pumping Project, including any indemnification agreements required by the federal government;(3) may acquire land or any other property right by any lawful means, including eminent domain;(4) is exempt fromTitle 63G, Chapter 6a, Utah Procurement Code ; and(5) may proceed without obtaining water right approval from the state engineer.
