Terms Used In Utah Code 76-8-317

  • Act: means a voluntary bodily movement and includes speech. See Utah Code 76-1-101.5
  • Actor: means a person whose criminal responsibility is in issue in a criminal action. See Utah Code 76-1-101.5
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) An actor commits refusal to comply with an order to evacuate or order issued in a local or state emergency if the actor:

     (2)(a) receives notice of:

          (2)(a)(i) an order to evacuate issued under Title 53, Chapter 2a, Emergency Management Act; or
          (2)(a)(ii) an order issued:

               (2)(a)(ii)(A) by the governor in a state of an emergency under Section 53-2a-204; or
               (2)(a)(ii)(B) by a chief executive officer in a local emergency under Section 53-2a-205; and
     (2)(b) refuses to comply with the order described in Subsection (2)(a).
(3) A violation of Subsection (2) is a class B misdemeanor.
