Terms Used In Utah Code 76-8-803

  • Actor: means a person whose criminal responsibility is in issue in a criminal action. See Utah Code 76-1-101.5
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conduct: means an act or omission. See Utah Code 76-1-101.5
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
(2) An actor commits causing or omitting to note defects in articles used in preparation for defense or war if the actor:

     (2)(a) intentionally makes or causes to be made or omits to note on inspection a defect in an article or thing; and
     (2)(b) has reasonable grounds to believe that the article or thing is intended to be used in connection with the preparation of the United States government or of a state government for defense or for war, or for the prosecution of war by the United States government.
(3) A violation of Subsection (2) is a third degree felony.
(4) Prior to the filing of a formal criminal complaint, evidence of an alleged actor’s conduct under Subsection (2) or the name of the actor may not be made public.
