(1) Terms defined in Sections 76-1-101.5, 76-8-101, and 76-8-901 apply to this section.

Terms Used In Utah Code 76-8-902

  • Act: means a voluntary bodily movement and includes speech. See Utah Code 76-1-101.5
  • Actor: means a person whose criminal responsibility is in issue in a criminal action. See Utah Code 76-1-101.5
  • Bodily injury: means physical pain, illness, or any impairment of physical condition. See Utah Code 76-1-101.5
  • Criminal syndicalism: means the doctrine that advocates crime, violence, force, arson, destruction of property, sabotage, or other unlawful acts or methods, as a means of accomplishing or effecting industrial or political ends, or as a means of effecting industrial or political revolution. See Utah Code 76-8-901
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Sabotage: means the unlawful and intentional damage or injury to, or destruction of, real or personal property, of an employer or owner by an individual. See Utah Code 76-8-901
(2) An actor commits advocating criminal syndicalism or sabotage if the actor:

     (2)(a) advocates, suggests, or teaches the duty, necessity, propriety, or expediency of crime, criminal syndicalism, or sabotage;
     (2)(b) as a means of accomplishing or effecting industrial or political ends, change, or revolution:

          (2)(b)(i) advocates, suggests, or teaches the duty, necessity, propriety, or expediency of performing an act of violence, destroying or damaging property, causing bodily injury to an individual, or committing a crime or unlawful act;
          (2)(b)(ii) prints, publishes, edits, or issues, or knowingly circulates, sells, distributes, or publicly displays a book, pamphlet, paper, handbill, poster, document, or written or printed matter in any form, containing, advocating, advising, suggesting, or teaching crime, criminal syndicalism, sabotage, performing an act of violence, the destruction of or damage to property, the injury to an individual, or the commission of a crime or unlawful act; or
          (2)(b)(iii) organizes or becomes a member of, or voluntarily assembles with, a society or assemblage of individuals formed to teach or advocate the doctrine of criminal syndicalism or sabotage, or the necessity, propriety, or expediency of doing an act of violence or the commission of a crime or unlawful act; or
     (2)(c) with the intent to exemplify, spread, or teach or suggest criminal syndicalism, attempts to justify sabotage, an act of violence, the destruction of or damage to property, the injury of an individual, or the commission of a crime or unlawful act.
(3) A violation of Subsection (2) is a third degree felony.
