(1) The district court or administrative agency may issue an order determining the amount of a parent‘s liability for medical expenses of a dependent child when the parent:

Terms Used In Utah Code 78B-12-213

  • Administrative agency: means the Office of Recovery Services or the Department of Health and Human Services. See Utah Code 78B-12-102
  • Administrative order: means an order that has been issued by the Office of Recovery Services, the Department of Health and Human Services, or an administrative agency of another state or other comparable jurisdiction with similar authority to that of the office. See Utah Code 78B-12-102
  • Child: means :
         (7)(a) a son or daughter under the age of 18 years who is not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States;
         (7)(b) a son or daughter over the age of 18 years, while enrolled in high school during the normal and expected year of graduation and not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States; or
         (7)(c) a son or daughter of any age who is incapacitated from earning a living and, if able to provide some financial resources to the family, is not able to support self by own means. See Utah Code 78B-12-102
  • Court: means the district court or juvenile court. See Utah Code 78B-12-102
  • Dependent: A person dependent for support upon another.
  • Medical expenses: means health and dental expenses and related insurance costs. See Utah Code 78B-12-102
  • Parent: includes a natural parent, or an adoptive parent. See Utah Code 78B-12-102
     (1)(a) is required by a prior court or administrative order to:

          (1)(a)(i) share those expenses with the other parent of the dependent child; or
          (1)(a)(ii) obtain insurance for medical expenses but fails to do so; or
     (1)(b) receives direct payment from an insurer under insurance coverage obtained after the prior court or administrative order was issued.
(2) If the prior court or administrative order does not specify what proportions of the expenses are to be shared, the district court may determine the amount of liability as may be reasonable and necessary.
(3) This section applies to an order without regard to when it was issued.
