(1) The Office of Vital Records shall send a copy of the filing to a person or entity set forth in Subsection (2), who has requested a copy. The copy of the filing shall be sent to the most recent address provided by the requestor.

Terms Used In Utah Code 78B-15-405

  • Child: means an individual of any age whose parentage may be determined under this chapter. See Utah Code 78B-15-102
  • Mother: means a parent who is of the female sex. See Utah Code 68-3-12.5
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Utah Code 78B-15-102
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, any territory, Native American Tribe, or insular possession subject to the jurisdiction of the United States. See Utah Code 78B-15-102
  • Support-enforcement agency: means a public official or agency authorized under Title IV-D of the Social Security Act which has the authority to seek:
         (25)(a) enforcement of support orders or laws relating to the duty of support;
         (25)(b) establishment or modification of child support;
         (25)(c) determination of parentage; or
         (25)(d) location of child-support obligors and their income and assets. See Utah Code 78B-15-102
  • Tribunal: means a court of law, administrative agency, or quasi-judicial entity authorized to establish, enforce, or modify support orders or to determine parentage. See Utah Code 78B-15-102
(2) Information contained in records which are filed pursuant to Section 78B-15-401 is confidential and may be released on request only to:

     (2)(a) a tribunal or a person designated by the tribunal;
     (2)(b) the mother of the child who is the subject of the filing;
     (2)(c) an agency authorized by other law to receive the information;
     (2)(d) a licensed child-placing agency;
     (2)(e) the Office of Recovery Services, the Office of the Attorney General, or a support-enforcement agency of another state or tribe;
     (2)(f) a party or the party’s attorney of record in a proceeding under this chapter or in a proceeding for adoption of, or for termination of parental rights regarding, a child who is the subject of the filing; and
     (2)(g) the registry of paternity in another state.
