(1) Except as otherwise provided in Subsection (2), if a law of this state requires or permits use of a sworn declaration, an unsworn declaration meeting the requirements of this chapter has the same effect as a sworn declaration.
Terms Used In Utah Code 78B-18a-104
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Oath: A promise to tell the truth.
- Oath: includes "affirmation. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) This chapter does not apply to:
(2)(a) a deposition;
(2)(b) an oath of office;
(2)(c) an oath required to be given before a specified official other than a notary public;
(2)(d) a declaration to be recorded under Title 57, Real Estate; or
(2)(e) an oath required by Section 75-2-504.
