As used in this part:

(1) “Breach of system security” means the same as that term is defined in Section 13-44-102.

Terms Used In Utah Code 78B-4-701

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
(2) “NIST” means the National Institute for Standards and Technology in the United States Department of Commerce.
(3) “PCI data security standard” means the Payment Card Industry Data Security Standard.

     (4)(a) “Person” means:

          (4)(a)(i) an individual;
          (4)(a)(ii) an association;
          (4)(a)(iii) a corporation;
          (4)(a)(iv) a joint stock company;
          (4)(a)(v) a partnership;
          (4)(a)(vi) a business trust; or
          (4)(a)(vii) any unincorporated organization.
     (4)(b) “Person” includes a financial institution organized, chartered, or holding a license authorizing operation under the laws of this state, another state, or another country.
(5) “Personal information” means the same as that term is defined in Section 13-44-102.
