Terms Used In Utah Code 78B-5-904

  • Behavioral emergency services technician: means an individual who is licensed under Section 53-2d-402 as:
         (1)(a) a behavioral emergency services technician; or
         (1)(b) an advanced behavioral emergency services technician. See Utah Code 78B-5-902
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

     In accordance with the Utah Rules of Evidence, a behavioral emergency services technician may refuse to disclose communications made by an individual during the delivery of behavioral emergency services as defined in Section 53-2d-101.
