Terms Used In Utah Code 78B-7-121

  • Abuse: means , except as provided in Section 78B-7-201, intentionally or knowingly causing or attempting to cause another individual physical harm or intentionally or knowingly placing another individual in reasonable fear of imminent physical harm. See Utah Code 78B-7-102
  • Court: means the district court or juvenile court. See Utah Code 78B-7-201
  • Protective order: means :
         (5)(a) a child protective order; or
         (5)(b) an ex parte child protective order. See Utah Code 78B-7-201
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a) As used in this section, “relevant proceeding” means a civil proceeding under this chapter:

          (1)(a)(i) between the parents of a child;
          (1)(a)(ii) that involves the care or custody of the child; and
          (1)(a)(iii) that concerns a protective order under this chapter.
     (1)(b) “Relevant proceeding” does not include:

          (1)(b)(i) any child protective, abuse, or neglect proceeding;
          (1)(b)(ii) a juvenile justice proceeding; or
          (1)(b)(iii) any child placement proceeding in which a state, local, or tribal government, a designee of such a government, or any contracted child welfare agency or child protective services agency of such a government is a party to the proceeding.
(2) In a relevant proceeding, the court shall comply with the standards described in Section 30-3-41.
