(1) The authority is responsible for:

- Authority: means the Youth Parole Authority created in Section
80-5-701 . See Utah Code 80-5-102 - Director: means the director of the Division of Juvenile Justice and Youth Services. See Utah Code 80-5-102
- Division: means the Division of Juvenile Justice and Youth Services created in Section
80-5-103 . See Utah Code 80-5-102 - Juvenile offender: means :(47)(a) a serious youth offender; or(47)(b) a youth offender. See Utah Code 80-1-102
- Parole: means a conditional release of a juvenile offender from residency in secure care to live outside of secure care under the supervision of the Division of Juvenile Justice and Youth Services, or another person designated by the Division of Juvenile Justice and Youth Services. See Utah Code 80-1-102
- Revocation: means the same as that term is defined in Section
80-6-102 . See Utah Code 80-5-102- Secure care: means placement of a minor, who is committed to the Division of Juvenile Justice and Youth Services for rehabilitation, in a facility operated by, or under contract with, the Division of Juvenile Justice and Youth Services, that provides 24-hour supervision and confinement of the minor. See Utah Code 80-1-102
- Termination: means the same as that term is defined in Section
80-6-102 . See Utah Code 80-5-102- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
(1)(a) the release of a juvenile offender from secure care; and(1)(b) the rescission, revocation, and termination of parole for a juvenile offender.
(2) In accordance with Chapter 6, Part 8, Commitment and Parole, the authority shall:
(2)(a) determine when and under what conditions a juvenile offender in secure care is eligible for parole;
(2)(b) establish policies and procedures regarding:
(2)(b)(i) the authority’s governance, meetings, and hearings;
(2)(b)(ii) the conduct of proceedings before the authority;
(2)(b)(iii) the parole of a juvenile offender; and
(2)(b)(iv) for which parole for a juvenile offender may be granted, rescinded, revoked, modified, and terminated; and
(2)(c) determine appropriate parole dates for juvenile offenders.
(3) The division‘s case management staff shall:
(3)(a) implement plans for parole; and
(3)(b) supervise a juvenile offender on parole.
(4) The division shall:
(4)(a) permit the authority to have reasonable access to a juvenile offender in secure care; and
(4)(b) furnish all pertinent data requested by the authority in matters of parole, revocation, and termination.
(5) The director shall appoint an administrative officer of the authority.
(6) The administrative officer is responsible for the day-to-day operations of the authority.
(7) The authority and the administrative officer have power to:
(7)(a) issue subpoenas;
(7)(b) compel attendance of witnesses;
(7)(c) compel production of books, papers, and other documents; and
(7)(d) administer oaths and take testimony under oath for the purposes of conducting the hearings.
(8) The administrative officer shall maintain summary records of all hearings and provide written notice to the juvenile offender of a decision and the reason for the decision.
