Terms Used In Utah Code 81-6-402

  • advisory committee: means the Child Support Guidelines Advisory Committee. See Utah Code 81-6-401
  • Child support: includes current periodic payments, arrearages that accrue under an order for current periodic payments, and sum certain judgments awarded for arrearages, medical expenses, and child care costs. See Utah Code 81-6-101
  • Office: means the Office of Recovery Services within the Department of Health and Human Services. See Utah Code 81-6-101
  • Quorum: The number of legislators that must be present to do business.
  • State: means a state, territory, possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Native American tribe, or other comparable domestic or foreign jurisdiction. See Utah Code 81-6-101
  • Support: means past-due, present, and future obligations to provide for the financial support, maintenance, or medical expenses of a child. See Utah Code 81-6-101
     (1)(a) There is created the advisory committee known as the “Child Support Guidelines Advisory Committee.”
     (1)(b) The governor shall appoint the 11 members of the advisory committee as follows:

          (1)(b)(i) one representative recommended by the Office of Recovery Services;
          (1)(b)(ii) one representative recommended by the Judicial Council;
          (1)(b)(iii) two representatives recommended by the Utah State Bar Association;
          (1)(b)(iv) two representatives of noncustodial parents;
          (1)(b)(v) two representatives of custodial parents;
          (1)(b)(vi) one representative with expertise in economics; and
          (1)(b)(vii) two representatives from diverse interests related to child support issues and who are not members of the Utah State Bar Association, as the governor may consider appropriate.

     (2)(a) The term of a member of the advisory committee is four years.
     (2)(b) When a vacancy occurs in the membership for any reason, the governor shall appoint a replacement for the unexpired term of the member.
     (2)(c) The governor may appoint a member of the advisory committee to more than one term.
(3)

     (3)(a) Six members of the advisory committee constitute a quorum.
     (3)(b) The vote of a majority of a quorum present is an action of the advisory committee.
(4) The advisory committee shall elect two members to serve as cochairs of the advisory committee for a term of one year.
(5) The advisory committee shall meet at the time and place designated by the cochairs.
