(1) As used in this section, “nonprofit support organization” means a nonprofit organization that:

Terms Used In Utah Code 9-1-211

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Department of Cultural and Community Engagement. See Utah Code 9-1-102
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
     (1)(a) is organized under the Utah Revised Nonprofit Corporation Act; and
     (1)(b) provides the following support for nonprofit organizations located in the state:

          (1)(b)(i) building operational capacity;
          (1)(b)(ii) improving the delivery of essential services in the state;
          (1)(b)(iii) providing professional training;
          (1)(b)(iv) providing technical support; or
          (1)(b)(v) encouraging collaboration with other nonprofit organizations, industry, and government agencies.
(2)

     (2)(a) There is created within the department the Nonprofit Capacity Grant Program.
     (2)(b) The purpose of the program is to provide grants to nonprofit support organizations.
(3)

     (3)(a) A nonprofit support organization that submits a proposal for a grant to the department shall include details in the proposal regarding:

          (3)(a)(i) the nonprofit support organization’s name;
          (3)(a)(ii) information about the nonprofit support organization’s activities and purpose;
          (3)(a)(iii) the nonprofit support organization’s budget;
          (3)(a)(iv) plans for sustaining the nonprofit support organization beyond the grant period;
          (3)(a)(v) specific proposals for how the nonprofit support organization would use the grant; and
          (3)(a)(vi) other information the department determines necessary to evaluate the proposal.
     (3)(b) When evaluating a proposal for a grant, the department shall consider:

          (3)(b)(i) the grant amount requested;
          (3)(b)(ii) the extent to which the proposal advances the goals described in Subsection (1)(b);
          (3)(b)(iii) the extent to which any additional funding sources or existing or planned partnerships may benefit the proposal; and
          (3)(b)(iv) the viability of the proposal.
(4) Subject to Subsection (3), the department may, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, make rules to establish:

     (4)(a) eligibility criteria for a grant;
     (4)(b) the form and process for submitting a proposal to the department for a grant;
     (4)(c) the process and criteria for determining the priority of applications received;
     (4)(d) the formula and method for determining a grant amount; and
     (4)(e) reporting requirements for a grant recipient.
