- Apprenticeship program: means a program that:(1)(a) combines paid on-the-job learning with formal classroom instruction to prepare students for careers; and(1)(b) includes:(1)(b)(i) structured on-the-job learning for students under the supervision of a skilled employee;(1)(b)(ii) classroom instruction for students related to the on-the-job learning;(1)(b)(iii) ongoing student assessments using established competency and skills standards; and(1)(b)(iv) the student receiving an industry-recognized credential or degree upon completion of the program. See Utah Code 53B-34-101
- Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
- Board: means the Utah Board of Higher Education described in Section 53B-1-402. See Utah Code 53B-1-101.5
- Career and technical education region: means an economic service area created in Section 35A-2-101. See Utah Code 53B-34-101
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Contract: A legal written agreement that becomes binding when signed.
- Contribution: means any of the following when done for political purposes:
(1)(a)(i) a gift, subscription, donation, loan, advance, or deposit of money or anything of value given to the judge or the judge's personal campaign committee;(1)(a)(ii) an express, legally enforceable contract, promise, or agreement to make a gift, subscription, donation, unpaid or partially unpaid loan, advance, or deposit of money or anything of value to the judge or the judge's personal campaign committee;(1)(a)(iii) any transfer of funds from another reporting entity or a corporation to the judge or the judge's personal campaign committee;(1)(a)(iv) compensation paid by any person or reporting entity other than the judge or the judge's personal campaign committee for personal services provided without charge to the judge or the judge's personal campaign committee; and(1)(a)(v) goods or services provided to or for the benefit of the judge or the judge's personal campaign committee at less than fair market value. See Utah Code 20A-12-301- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Corporation: means a domestic or foreign, profit or nonprofit, business organization that is registered as a corporation or is authorized to do business in a state and makes any expenditure from corporate funds for political purposes. See Utah Code 20A-12-301
- Detailed listing: means :
(3)(a) for each contribution:(3)(a)(i) the name and address of the individual or source making the contribution, to the extent that the name or address of the individual or source is known;(3)(a)(ii) the amount or value of the contribution; and(3)(a)(iii) the date the contribution was made; and(3)(b) for each expenditure:(3)(b)(i) the amount of the expenditure;(3)(b)(ii) the person or entity to whom it was disbursed;(3)(b)(iii) the specific purpose, item, or service acquired by the expenditure; and(3)(b)(iv) the date the expenditure was made. See Utah Code 20A-12-301- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Donor: The person who makes a gift.
- Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
- Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Expenditure: means :
(4)(a)(i) any disbursement from contributions or from the separate bank account required by this chapter;(4)(a)(ii) a purchase, payment, donation, distribution, loan, advance, deposit, gift of money, or anything of value made for political purposes;(4)(a)(iii) an express, legally enforceable contract, promise, or agreement to make any purchase, payment, donation, distribution, loan, advance, deposit, gift of money, or anything of value for political purposes;(4)(a)(iv) compensation paid by a corporation or reporting entity for personal services rendered by a person without charge to the judge or the judge's personal campaign committee;(4)(a)(v) a transfer of funds between the judge's personal campaign committee and another judge's personal campaign committee; or(4)(a)(vi) goods or services provided by the judge's personal campaign committee to or for the benefit of another judge for political purposes at less than fair market value. See Utah Code 20A-12-301- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- High quality professional learning: means the professional learning standards for teachers and principals described in Section 53G-11-303. See Utah Code 53B-34-101
- Individual: means a natural person. See Utah Code 20A-12-301
- Institution of higher education: means the University of Utah, Utah State University, Southern Utah University, Weber State University, Snow College, Utah Tech University, Utah Valley University, or Salt Lake Community College. See Utah Code 53B-34-101
- Interim report: means a report identifying the contributions received and expenditures made since the last report. See Utah Code 20A-12-301
- Local education agency: means a school district, a charter school, or the Utah Schools for the Deaf and the Blind. See Utah Code 53B-34-101
- Master plan: means the computer science education master plan described in Section 53B-34-105. See Utah Code 53B-34-101
- Participating employer: means an employer that:
(8)(a) partners with an educational institution on a curriculum for an apprenticeship program or work-based learning program; and(8)(b) provides an apprenticeship or work-based learning program for students. See Utah Code 53B-34-101- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Personal campaign committee: means the committee appointed by a judge to act for the judge as provided in this chapter. See Utah Code 20A-12-301
- Political purposes: means an act done with the intent or in a way to influence or tend to influence, directly or indirectly, any person to refrain from voting or to vote for or against any judge standing for retention at any election. See Utah Code 20A-12-301
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Regular general election: means the election held throughout the state on the first Tuesday after the first Monday in November of each even-numbered year for the purposes established in Section
20A-1-201 . See Utah Code 20A-1-102- Reporting entity: means a judge, judge's personal campaign committee, candidate, a candidate's personal campaign committee, an officeholder, and a party committee, a political action committee, and a political issues committee. See Utah Code 20A-12-301
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State board: means the State Board of Education. See Utah Code 53B-34-101
- Summary report: means the year-end report containing the summary of a reporting entity's contributions and expenditures. See Utah Code 20A-12-301
- Talent board: means the Talent, Education, and Industry Alignment Board created in Section 53B-34-102. See Utah Code 53B-34-101
- Talent program: means the Talent Ready Utah Program created in Section 53B-34-103. See Utah Code 53B-34-101
- Technical college: means :
(13)(a) the same as that term is defined in Section Utah Code 53B-34-101- Technical education: means career and technical education that:
(8)(a)(i) leads to a certificate; or(8)(a)(ii) is short-term training. See Utah Code 53B-1-101.5- Work-based learning program: includes the following objectives:
(14)(b)(i) providing students an applied workplace experience using knowledge and skills attained in a program of study that includes an internship, externship, or work experience;(14)(b)(ii) providing an educational institution with objective input from a participating employer regarding the education requirements of the current workforce; and(14)(b)(iii) providing funding for programs that are associated with high-wage, in-demand, or emerging occupations. See Utah Code 53B-34-101- Workforce programs: means education or industry programs that facilitate training the state's workforce to meet industry demand. See Utah Code 53B-34-101
- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
