Terms Used In Utah Code > Title 20A > Chapter 2 > Part 3 - Voter Registration Responsibilities

  • Assisting political subdivision: means a political subdivision that provides emergency services to a political subdivision in another state in accordance with a local emergency response agreement between the political subdivisions. See Utah Code 53-2b-102
  • Ballot: means the storage medium, including a paper, mechanical, or electronic storage medium, that records an individual voter's vote. See Utah Code 20A-1-102
  • Certification: includes any license, certificate, permit, document, or other evidence issued by a government entity that authorizes a person to engage in an activity, within the person's scope of practice, that requires a specific skill set, education, expertise, or other qualifications. See Utah Code 53-2b-102
  • Contract: A legal written agreement that becomes binding when signed.
  • Disaster: means an event that:
         (5)(a) causes, or threatens to cause, loss of life, human suffering, public or private property damage, or economic or social disruption resulting from attack, internal disturbance, natural phenomena, or technological hazard; and
         (5)(b) requires resources that are beyond the scope of local agencies in routine responses to emergencies and accidents and may be of a magnitude or involve unusual circumstances that require response by government, not-for-profit, or private entities. See Utah Code 53-2a-102
  • Discretionary voter registration agency: means each office designated by the county clerk to provide voter registration forms to the public. See Utah Code 20A-2-300.5
  • Division: means the Division of Emergency Management created in Section 53-2a-103. See Utah Code 53-2a-102
  • Election: means a regular general election, a municipal general election, a statewide special election, a local special election, a regular primary election, a municipal primary election, and a special district election. See Utah Code 20A-1-102
  • Emergency: means :
         (3)(a) a natural or man-made disaster, a riot, a civil disturbance, violence, criminal activity, a fire, a flood, or extreme weather;
         (3)(b) an injury, illness, or other medical condition that requires an expedited response; or
         (3)(c) a circumstance that presents an imminent threat to life, property, or the public health, safety, or welfare. See Utah Code 53-2b-102
  • Emergency responder: means a person employed by, under contract with, or acting as an official volunteer for a political subdivision of a state that provides emergency services, including any of the following:
         (4)(a) a law enforcement officer;
         (4)(b) a firefighter;
         (4)(c) a provider of medical services or first aid;
         (4)(d) an explosives expert;
         (4)(e) a person who provides hazardous materials containment or cleanup; or
         (4)(f) another provider of emergency services. See Utah Code 53-2b-102
  • Emergency responder: includes a:
         (1)(a) firefighter;
         (1)(b) structural engineer;
         (1)(c) physician;
         (1)(d) physician assistant;
         (1)(e) paramedic; or
         (1)(f) technical rescue specialist. See Utah Code 53-2a-1601
  • Emergency response team: means a group of emergency responders placed at the direction, control, and funding of the Division of Emergency Management, in accordance with an agreement between the Division of Emergency Management and a sponsoring agency and the provisions of this part, to assist in urban search and rescue:
         (2)(a) in response to a disaster, emergency, or important event; or
         (2)(b) in anticipation of a forecasted severe weather event, a flood, or a planned important event. See Utah Code 53-2a-1601
  • Emergency response team member: means an individual who is:
         (3)(a) an emergency responder;
         (3)(b) a member of an emergency response team; and
         (3)(c) acting within the scope of the individual's duties for an emergency response team. See Utah Code 53-2a-1601
  • Emergency services: means services provided by a public entity in response to an emergency. See Utah Code 53-2b-102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Important event: includes an event attended by one or more officials of the United States or one or more foreign dignitaries and where a large crowd has or is anticipated to gather. See Utah Code 53-2a-1601
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Interstate emergency response agreement: means an agreement described in Subsection 53-2b-202(1) between Utah and another state authorizing a political subdivision in Utah to enter into an agreement to provide emergency services to, and receive emergency services from, a political subdivision in the other state. See Utah Code 53-2b-102
  • Law enforcement officer: means the same as that term is defined in Section 53-13-103. See Utah Code 53-1-102
  • Local emergency response agreement: means an agreement described in Subsection 53-2b-202(2)(a) that is:
         (7)(a) between a political subdivision in Utah and a political subdivision in another state, providing for the provision of emergency services to, or the receipt of emergency services from, each other; and
         (7)(b) entered into under the provisions of this chapter. See Utah Code 53-2b-102
  • Motor vehicle: means every self-propelled vehicle and every vehicle propelled by electric power obtained from overhead trolley wires, but not operated upon rails, except motorized wheel chairs and vehicles moved solely by human power. See Utah Code 53-1-102
  • Official register: means the official record furnished to election officials by the election officer that contains the information required by Section 20A-5-401. See Utah Code 20A-1-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Provisional ballot: means a ballot voted provisionally by a person:
         (55)(a) whose name is not listed on the official register at the polling place;
         (55)(b) whose legal right to vote is challenged as provided in this title; or
         (55)(c) whose identity was not sufficiently established by a poll worker. See Utah Code 20A-1-102
  • Public assistance agency: means each office in Utah that provides:
         (2)(a) public assistance; and
         (2)(b) state funded programs primarily engaged in providing services to people with disabilities. See Utah Code 20A-2-300.5
  • Registration form: means a form by which an individual may register to vote under this title. See Utah Code 20A-1-102
  • Requesting political subdivision: means a political subdivision that requests emergency services from a political subdivision in another state in accordance with a local emergency response agreement between the political subdivisions. See Utah Code 53-2b-102
  • Sponsoring agency: means an entity in the state that executes a written agreement to organize a National Urban Search and Rescue Response System task force as described in Utah Code 53-2a-1601
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Urban search and rescue: means the location, extrication, and initial medical stabilization of victims trapped in a confined space as the result of a structural collapse, transportation accident, mining accident, or collapsed trench. See Utah Code 53-2a-102
  • Voter: means an individual who:
         (79)(a) meets the requirements for voting in an election;
         (79)(b) meets the requirements of election registration;
         (79)(c) is registered to vote; and
         (79)(d) is listed in the official register book. See Utah Code 20A-1-102
  • Voter registration deadline: means the registration deadline provided in Section Utah Code 20A-1-102
  • Writing: includes :
         (48)(a) printing;
         (48)(b) handwriting; and
         (48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
